Samantha Fair's professional negligence claim

Samantha Fair lived with her family in council accommodation in Birmingham.

Due to the house being damp and in a poor state of repair, she and her brother both developed a chest condition, which lasted over a year.

As a result she instructed a firm of solicitors in Birmingham to make a personal injury claim on her behalf, with her mother acting as the litigation friend.

The solicitors in question issued legal proceedings, but unfortunately they failed to observe the automatic directions (or court timetable) then in force. This resulted in the personal injury claim being struck out.

This firm had previously acted for her mother, in a seperate accident at work claim. We were therefore happy to accept further instructions to act for the daughter in a professional negligence claim against the solicitors concerned.
