Roger Orriss' industrial injury claim

Roger Orriss worked as an assembler of industrial refrigeration units, at a factory in Essex.

His job involved working with a fellow employee and manually handling large components as each unit was assembled.

The client was unfortunate enough to suffer two separate accidents. On both occasions he suffered an injury to his thumb, which was bent backwards excessively. Following the second accident he was unable to return to work and eventually had to obtain alternative employment.

As a result he instructed this firm to make a personal injury claim on his behalf.

The compensation claim was advanced on the basis of a breach of the Manual Handling Regulations, these being part of the European Union legislation commonly used in accident at work claims involving injuries caused by heavy lifting.

Liability was initially denied. However as matters progressed the opposing insurers eventually conceded fault in relation to both accidents.

A medical report was obtained, leading to constructive settlement negotiations. Due to the lengthy medical investigations, proceedings had to be issued for limitation purposes. The personal injury claim was brought to a successful conclusion following the exchange of witness statements.
