Katerina Beranova had a part time job as a waitress at a fast food restaurant chain in Finchley Road, North London.

The system of work employed at the restaurant was that the kitchen staff would hand the food order to the waiters and waitresses, who would then serve the customers sitting at their tables.

However one evening there was a shortage of staff, as a result of which the client had to collect the deserts herself. While opening a refrigerator for this purpose, one of the hinges came loose, causing the door to strike the client on the forehead. As a result she suffered a laceration.

As a result she instructed this firm to make a personal injury claim on her behalf.

Due to the transient nature of the staff employed at the restaurant, many of whom did not speak English, it was not possible to obtain supporting witness evidence. Nevertheless liability was admitted at an early stage, by which the insurers of her employers agreed to pay compensation.
