Neil Talbot's Industrial Accident Claim

Neil Talbot was employed by the defendants as a sheet metalworker at a workshop in north Birmingham.

Part of his job involved operating a power operated guillotine, used for slicing sheet metal. The machine was defective, in that the guard was ineffective. Furthermore the floor area in front of the machine was cluttered with debris, due to the defendants failing to operate an adequate system of housekeeping.

The accident happened when the client tripped while approaching the machine. He was flung forwards, causing two of his fingers came in contact with the descending blade. He suffered a traumatic amputation of the tips of two fingers.

He instructed this firm to make a personal injury claim on his behalf, in respect of his accident at work.

The defendants initially denied liability, although they later conceded fault, although alleging contributory negligence. The industrial accident claim was advanced on the basis of numerous breaches of health and safety legislation, and eventually settlement was achieved on a full liability basis.

Two separate medical reports had to be obtained. The personal injury claim was brought to a successful conclusion shortly after court proceedings were issued.
