Who pays the "no win no fee" lawyer's legal costs?

In personal injury cases generally in England and Wales, the normal rule is that "costs follow the event".

In other words, the losing opponent must pay the legal costs and expenses incurred by the successful no win no fee lawyer.

Assuming that your claim is successful, the losing opponent must also pay your compensation.

Irrespective of whether your claim is based on a "no win no fee" agreement or private funding, the above rule still applies.

Will there be any deductions from my compensation, assuming a successful outcome?

In the great majority of cases, I make no deductions from your final compensation, thereby leaving you with 100% of your award.

However, there are certain exceptions, particularly where:

  • Limitation expires in under 12 months. This can create difficulty firstly in securing the co-operation of lay witnesses, and secondly in assembling supporting medical evidence.
  • Your claim was originally started by (or rejected by) another lawyer. In such cases there is always a risk that the claim will not succeed.

If any of the above applies, I will discuss the options fully before agreeing to act for you.

What is the usual outcome in a successful "no win no fee" compensation claim?

In a typical no win no fee claim, the normal outcome is that the opponents will pay your damages.

Additionally, they will also pay your lawyer's costs.

Finally, the other side also have to meet their own legal costs.
