Bicycle Accident Claim

I am currently running two bicycle accident claims. On each occasion the injury was caused by dangerous potholes in the road.
Case Study 1: Claim against London Borough of Southwark
The main features of this London claim are as follows:
- The bicycle accident happened in the hours of darkness
- My client was returning home from the shops, on his bike
- The front wheel went down a large pothole
- This threw my client over the handlebars
- As a result my client suffered a dislocated elbow
- The pothole was located at the junction with a private road
- I made claims firstly against the local authority, and secondly against the owner of the private road
- They both denied liability and blamed each other initially
- However in a sudden change of heart, the council conceded negligence
Case Study 2: Bicycle accident claim against Southampton City Council
The important features of this Southampton claim are as follows:
- The accident took place on a quiet Sunday afternoon
- The client was testing her new bicycle
- The front wheel of the bicycle struck and uneven section of road that had been inadequately repaired
- Again, the client was thrown over the handlebars
- As a result, the client broke her arm
As a cyclist myself, it is very obvious that the state of the roads appears to be deteriorating year on year. Some cities such as Southampton appear to be particularly bad.
The Cyclists Touring Club run a separate website where it is possible to report potholes to the local authority, via www.fillthathole.org.uk.
